Application of These Terms

These Terms and Conditions apply to your use of our website and to all purchases of products made through any website operated by Select Trade Brands (the “Website”).

By accessing the Website, creating an account, or placing an order, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you must not use the Website or place an order.

We recommend that you read these Terms carefully and retain a copy for your records, as they set out your legal rights and obligations and the terms on which we supply goods to you.

This Website and all associated websites listed below are owned and operated by Select Trade Brands Ltd, a company registered in England and Wales. Our registered office is: Select Trade Brands Ltd, Loribon House, Aspen Way, Yalberton Industrial Estate, Paignton, Devon, TQ4 7QR.

References in these Terms to “we”, “us”, and “our” mean Select Trade Brands Ltd. References to the “Website” include all websites operated by us, including but not limited to: Trade Counter Direct, Select Products International, Trade Work Wear, Meter Boxes Now, Access Panel Store, HiKOKI Power Tools Direct, and MeterBoxes.co.uk. These Terms and Conditions apply to all orders placed through any such Website unless expressly stated otherwise.

All content made available on the Website, including but not limited to text, product descriptions, images, graphics, logos, branding, layout, and software, is the property of, or licensed to, Select Trade Brands Ltd and is protected by UK and international intellectual property laws.

You may access and use the Website for lawful purposes only. You may view, download, and print content from the Website for your own personal, non-commercial use. You must not copy, reproduce, distribute, modify, transmit, republish, display, or otherwise exploit any Website content for commercial purposes without our prior written consent.

Nothing in these Terms grants you any rights in or to our intellectual property or that of our licensors, except as expressly stated.

Changes to These Terms and Conditions

We may update or amend these Terms and Conditions from time to time to reflect changes in our business practices, legal or regulatory requirements, or the way in which we supply our products.

Any changes will be published on the Website and will take effect from the date of publication. The Terms and Conditions in force at the time you place your order will apply to that order.

We will not make any changes to these Terms that affect an order you have already placed and which has been accepted by us, unless such changes are required by law or are agreed with you.

Your continued use of the Website following the publication of any updates constitutes acceptance of the revised Terms and Conditions.

1. Order Process and Acceptance

1.1 When you place an order through the Website, you will receive an automated email acknowledging receipt of your order. This acknowledgement is for information purposes only and does not constitute acceptance of your order.

1.2 All orders are subject to acceptance and availability. A legally binding contract between you and Select Trade Brands Ltd will only be formed when we send you a despatch confirmation email confirming that the goods have been despatched.

1.3 Until a despatch confirmation email has been issued, we reserve the right to refuse or cancel any order at our discretion, including but not limited to where:
(a) the product is out of stock, unavailable or discontinued;
(b) there is an error in the price, product description or Website content;
(c) we are unable to obtain authorisation for payment;
(d) we reasonably suspect fraudulent, unauthorised or unlawful activity; 
(e) there are errors or inaccuracies in the order details provided by you; or
(f) supply issues arise from manufacturers, suppliers, or factors outside our reasonable control.

1.4 Whilst we make reasonable efforts to ensure that stock availability displayed on the Website is accurate, stock levels may change and availability cannot be guaranteed.

1.5 If a product becomes unavailable after your order has been placed but before despatch, we will notify you as soon as reasonably practicable using the contact details provided with your order. You will be given the option to:
(a) wait for the item to become available (where possible);
(b) accept a suitable alternative (if available); or
(c) cancel the affected item(s) for a full refund.

1.6 If we do not receive a response within 7 days of our notification regarding unavailable goods, we reserve the right to cancel the unavailable item(s) and issue a refund for those item(s) to the original payment method. Any remaining available items may still be processed and despatched.

1.7 If we are unable to accept or fulfil your order in whole or in part, we will notify you as soon as reasonably practicable and any payment taken for unavailable goods will be refunded in full using the original payment method.

1.8 It is your responsibility to ensure that all order details, including delivery address, billing information, product specifications, quantities, and contact details, are accurate and complete at the time of placing the order. You are advised to check all details carefully before confirming your order, as amendments may not always be possible once processing has begun. We shall not be liable for delays, failed delivery, or additional costs arising from incorrect or incomplete information supplied by you, although we will use reasonable efforts to assist where possible.

1.9 We sell products to both consumers and business customers. Where you purchase goods in the course of a business, certain statutory consumer rights may not apply, as permitted by applicable law.

2. Pricing 

2.1 All prices displayed on the Website are shown in pounds sterling (£) and are displayed both inclusive and exclusive of VAT, where applicable. The applicable VAT rate will be clearly indicated at checkout.

2.2 Prices and product information are subject to change at any time without notice. However, such changes will not affect orders that have already been accepted in accordance with Section 1 (Order Process and Acceptance).

2.3 Whilst we take reasonable care to ensure that prices and product details on the Website are accurate, errors may occasionally occur. Where a pricing or product description error is identified, we reserve the right to cancel or refuse any affected order in accordance with Section 1 (Order Process, Acceptance and Availability).

2.4 In the event of a pricing error, we are under no obligation to supply goods at the incorrect price, even if an order acknowledgement has been issued, provided that the error is obvious and could reasonably have been recognised as a pricing mistake.

2.5 Prices for products may change from time to time due to factors including supplier pricing, market conditions, promotions, or catalogue updates. The price payable for goods will be the price displayed at the time you place your order.

2.6 Price changes made after an order has been placed will not affect that order once it has been accepted in accordance with Section 1 (Order Process and Acceptance). We do not offer retrospective price adjustments or price matching in respect of orders placed before or after any price changes.

3. Delivery Charges

3.1 Any applicable delivery charges will be calculated and clearly displayed during the checkout process before you confirm your order, and will form part of the total price payable.

3.2 Delivery charges may vary depending on the size, weight, quantity, delivery method and delivery location of the goods, including where pallet or specialist courier services are required.

4. Delivery, Locations and Timeframes

4.1 Estimated delivery times are provided for guidance only and are not guaranteed unless expressly stated otherwise in writing. Delivery timeframes begin from the date of despatch, not the date the order is placed.

4.2 Whilst we make reasonable efforts to meet estimated delivery times, delays may occur due to factors outside our reasonable control, including courier delays, supplier issues, stock availability, adverse weather, or high demand periods.

4.3 Delivery services may not be available to certain remote, offshore, or restricted locations. If delivery to the address provided is not possible or is subject to additional restrictions or surcharges, we will notify you as soon as reasonably practicable. 

4.4 Where delivery cannot be fulfilled to the specified address, we reserve the right to cancel the order and issue a refund for the affected goods in accordance with these Terms.

4.5 For deliveries outside Great Britain or to locations subject to additional customs requirements, you may be required to pay import duties, customs charges, taxes, or additional fees imposed by the destination country or region. These charges are not included in the price of the goods or delivery costs and are the responsibility of the recipient.

4.6 You are responsible for ensuring that any goods ordered comply with the import laws, regulations, and standards of the destination country or region. We shall not be liable for any delays, additional charges, confiscation, or failed delivery resulting from customs regulations, import restrictions, or non-compliance with local laws.

5. Payment

5.1 Payment must be made in full at the time of placing an order using the payment methods made available on the Website, which may include debit card, credit card, PayPal, Klarna, or other approved payment providers.

5.2 All payments are subject to validation, security screening, and authorisation by the relevant payment provider. We reserve the right to refuse or cancel any order where payment authorisation is declined or where fraudulent activity is reasonably suspected.

5.3 Where payment has been taken and an order is subsequently cancelled in accordance with these Terms, a refund will be issued to the original payment method without undue delay.

6. Delivery Risk and Title

6.1 The risk of loss or damage to the goods will pass to you when the goods are delivered to the delivery address provided in your order and come into your physical possession, or the possession of a person identified by you to take delivery.

6.2 Where delivery is completed in accordance with your delivery preferences or instructions provided to the courier (including via courier apps, delivery management options, or nominated safe place or neighbour instructions), the goods shall be deemed delivered and risk will pass to you at that point.

6.3 Where the courier provides confirmation of delivery, including photographic evidence, GPS confirmation, or delivery scan records, this shall constitute proof of delivery unless there is clear evidence to the contrary.

6.4 Ownership (title) of the goods will only pass to you once we have received full payment in cleared funds for the goods, including any applicable delivery charges.

7. Delivery Issues, Claims and Courier Procedures

7.1 You must inspect the goods as soon as reasonably practicable after delivery and notify us promptly if any goods are damaged, defective, or missing. We recommend reporting any damage, loss, or discrepancies within 5 working days of receipt to assist with courier investigations, although your statutory rights remain unaffected.

7.2 Where goods arrive damaged, incomplete, or with visible transit damage, we may request photographic evidence of the goods, packaging, and labels to assess and process the claim. You should retain all packaging and damaged items until the claim has been reviewed, as these may be required for inspection or verification.

7.3 Our courier partners operate strict timeframes for loss and damage investigations. Where we request supporting information or evidence (such as photographs, documentation, or signed declarations), this should be provided as soon as possible and, in any event, within 14 days of delivery to enable a timely courier claim.

(a) If you are a business customer, failure to provide the requested evidence within this timeframe may result in the courier claim being rejected, which may limit the options available to resolve the claim.

(b) If you are a consumer, we will continue to consider your statutory rights in accordance with the Consumer Rights Act 2015, although delays in providing requested evidence may affect the speed and outcome of the investigation.

7.4 If a parcel is believed to be missing, you must notify us as soon as reasonably practicable. We recommend reporting missing parcels within 7 working days of the expected delivery date to allow timely investigation with the courier.

7.5 Where a parcel is reported missing, we will initiate an investigation with the relevant courier. This may include delivery confirmation checks, GPS data, photographic delivery evidence, or a signed Denial of Receipt declaration where required by the courier. You agree to reasonably cooperate with any courier investigation process.

7.6 Failure to cooperate with a courier investigation, including returning required documentation within the specified timeframe, may delay the investigation and affect the resolution of the claim.

7.7 If the courier confirms that delivery was completed in accordance with your delivery instructions, nominated safe place, neighbour authorisation, or courier delivery preferences, the goods shall be deemed delivered and risk will remain with you in accordance with Section 6 (Delivery Risk and Title).

7.8 If delivery cannot be completed due to incorrect address details, failure to accept delivery, lack of access, or refusal of delivery, we reserve the right to charge any reasonable redelivery, storage, or return courier costs incurred.

7.9 Where delivery is unsuccessful after multiple attempts or the parcel is returned to us, we may deduct any applicable return and re-delivery costs from any refund, where permitted by law.

7.10 Next Day or expedited delivery services are subject to availability, order cut-off times, and delivery location. Such services are estimates only and are not guaranteed unless expressly stated in writing.

7.11 We shall not be liable for delivery delays or failure to perform delivery obligations where such delays arise from events outside our reasonable control, including but not limited to courier network disruptions, adverse weather, industrial action, supply chain issues, or force majeure events.

Returns, Cancellations and Refunds

8. Right to Cancel

8.1 If you are a consumer, you have the legal right to cancel your order within 14 days from the day after you receive the goods, in accordance with the Consumer Contracts Regulations 2013.

8.2 To exercise your right to cancel, you must inform us of your decision to cancel by a clear statement (for example by email, contact form, or in writing).

8.3 Once you have notified us of cancellation, you must return the goods within 14 days of informing us of your decision to cancel.

9. Refunds

9.1 If you cancel your order within the statutory cancellation period, we will refund all payments received from you for the cancelled goods.

9.2 Refunds will be issued to the original payment method without undue delay and in any event within 14 days of:
(a) receiving the returned goods; or
(b) receiving evidence that the goods have been returned.

9.3 If the order is cancelled before despatch, a full refund will be issued.

9.4 We are not responsible for delays in refund processing caused by payment providers, banks, or card issuers once the refund has been submitted.

10. Returns Process and Condition of Goods

10.1 Returned goods should be sent back in their original condition, including any packaging, accessories, and documentation where reasonably possible.

10.2 You may inspect the goods as you would in a retail store. However, we may make a reasonable deduction from the refund for any loss in value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functionality.

10.3 Consumers are responsible for the cost of returning goods unless the items are faulty, damaged, or not as described.

10.4 We recommend using a tracked delivery service for returns. Returned goods remain your responsibility until they are safely received at our designated returns address.

10.5 Made-to-order, customised, or personalised products are exempt from the statutory right to cancel unless they are faulty, damaged, or not as described.

10.6 For business customers, returns are accepted at our discretion and may be subject to a restocking fee or return conditions, which will be confirmed at the time of the return request.

10.7 Where a free promotional item is supplied as part of a qualifying purchase, the promotional item must also be returned if the main goods are returned for a refund.

10.8 If the promotional item is not returned, we reserve the right to deduct the retail value of the promotional item from the refund.

Faulty Goods, Warranty and Repairs

11. Consumer Statutory Rights

11.1 Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015. If goods are faulty, not as described, or unfit for purpose, you are entitled to a repair, replacement, or refund in accordance with applicable law.

12. Faults 

12.1 If a fault is identified within 30 days of receipt, you may be entitled to reject the goods and receive a full refund, repair, or replacement, subject to inspection and confirmation of the fault.

12.2 For faults arising after 30 days but within the manufacturer’s warranty period, we will assess the issue and may arrange inspection, repair, or replacement in accordance with the manufacturer’s warranty terms.

12.3 Where appropriate, we may liaise directly with the manufacturer or authorised repair agents on your behalf to facilitate the warranty process.

13. Manufacturer Warranties

13.1 Many products, including power tools and accessories, are supplied with a manufacturer’s warranty of at least 12 months from the date of purchase.

13.2 Some manufacturers offer extended warranties, which may require product registration directly with the manufacturer. It is the customer’s responsibility to complete any required registration to benefit from extended warranty coverage.

14. Wear and Tear Exclusions

14.1 Components subject to normal wear and tear are not covered under manufacturer warranties or goodwill guarantees. This may include, but is not limited to, service and maintenance kits, carbon brushes, bearings, chucks, drill bit attachments, power cords, auxiliary handles, carry cases, sanding plates, dust bags, dust exhaust tubes, felt washers, and impact wrench pins and springs.

15. Inspections, Misuse and Chargeable Repairs

15.1 Returned items may be inspected to determine the cause of the fault.

15.2 If an inspection determines that the fault is due to misuse, accidental damage, improper installation, normal wear and tear, or failure to follow manufacturer instructions, the fault may not be covered by warranty.

15.3 In such cases, we will notify you in advance of any repair costs, return postage charges, or alternative options and will not proceed with any chargeable repairs without your approval.

15.4 You may request the return of the item without repair, in which case reasonable return postage costs may apply.

15.5 Repair and inspection timeframes may vary depending on the product type, manufacturer requirements, and availability of replacement parts.

16. Liability

16.1 Nothing in these Terms shall limit or exclude our liability for:
(a) death or personal injury caused by our negligence;
(b) fraud or fraudulent misrepresentation; or
(c) any matter for which liability cannot be limited or excluded under applicable law.

16.2 Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015.

16.3 To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential losses, including but not limited to loss of profit, loss of revenue, loss of business, or loss of data, arising out of or in connection with the use of our Website or the purchase of goods.

16.4 Our total liability to you in respect of any direct loss arising from the supply of goods shall be limited to the total price paid for the goods in question.

16.5 We shall not be liable for any loss arising from:
(a) misuse, improper installation, or improper use of the goods;
(b) failure to follow manufacturer instructions or safety guidance;
(c) normal wear and tear, accidental damage, or external factors outside our control.

16.6 Where goods are purchased for business or trade use, we shall not be liable for any loss of profit, loss of business, loss of contracts, or any other commercial or economic losses.
